Compensation for pedestrians

MRS DOMINIKA’S ACCIDENT

Ms. Dominika came home from work in the restaurant. As she crossed the pedestrian lanes, she was struck by an oncoming vehicle when the light was on green and safe to cross. As a result of the impact, Ms. Dominika lost consciousness, hit her head on the street, suffering extensive brain edema, broke 3 ribs and a bone in her arm. The perpetrator stopped for a moment and then fled the scene of the accident. To this day, it remains elusive despite the fact that the area was monitored. The car did not have registration numbers, as it turned out, it was stolen. An ambulance service arrived at the scene of the accident and transported Ms. Dominika to a nearby hospital. There, she received appropriate medical supplies and underwent 2 operations. She was in a coma for several weeks. After waking up, Dominika found out that the perpetrator remained unknown. Can she get compensation?

THE ANSWER IS YES!

Liability for unidentified and uninsured drivers

Ms. Dominika can apply for compensation from the so-called the guarantee fund (Motor Insurers’ Bureau – MIB) . Even if the perpetrator of the accident is unknown or did not have valid insurance at the time of the incident, the victim of a motor vehicle accident in England can claim their rights through the MIB guarantee fund. ABS Lawyers’ lawyers have had many cases of this type behind them and they know how to protect your interests in this type of proceedings, even if you were in a serious condition after the accident and were unable to adequately secure evidence at the scene.

Compensation from the MIB. How long does the procedure take?

Of course, it should be noted that each case is different, so the times at which the MIB decides whether or not the compensation should be paid may also differ. If the case is not overly complicated and we are, for example, dealing with a person injured in a traffic accident caused by an uninsured driver, then the case usually lasts from 6 to 12 months . In the case of Ms. Dominika, the case took a bit longer, because the perpetrator of the accident was unknown, the car involved in the collision was stolen, and Ms. Dominika’s injuries were complex, so there were slightly more complicated procedures involved.

Is MIB Compensation Lower?

When you apply for compensation from the MIB, you can get an amount comparable to what would be awarded for the same type of accident once the perpetrator was known and insured. However, a lot in these matters depends on the lawyers, so in this type of cases it is worth using the help of professionals!  The amount of compensation depends on the injuries suffered by the victim. In the case of Ms. Dominika, who underwent two operations after the accident and was in a coma, the compensation was high, because it had to take into account both her health detriment, costs related to hospitalisation and physical and mental rehabilitation, as well as any material losses incurred as a result of incapacity for work after an accident and during rehabilitation.
